Fireworks Purchase & Discharge Regulations for Lummi Island!

Fire Safety Considerations:

Please remember to only set off fireworks in a large unenclosed safe area and on a solid surface or sand.   Never hold a lit firecracker.   Any Flying fireworks are to be avoided (see below), but if you insist, they are best done on a beach and carefully aimed out to water. These are very dangerous for trees and vegetation.

State & Whatcom County

State law governs the regulation of fireworks, including what fireworks are legal, licensing for public fireworks displays and for fireworks sellers, and when fireworks may be discharged.

The Washington State Patrol (WSP) enforces the state fireworks laws (see chapter 70.77 RCW and chapter 212-17 WAC). For information on general fireworks laws, licensing, and fireworks information for emergency services, see the WSP Fireworks page.

The Whatcom County Sherriff’s Office enforces the Whatcom County fireworks regulations on the Island.  If you have an issue with fireworks being set off on the Island, Call 911.
DO NOT call the Lummi Island Fire Department as they have no authority to stop people from using fireworks.  They only extinguish fires.

Legal Fireworks

Consumer fireworks sold at a Washington State Licensed and Whatcom County Permitted stand are allowed to be used in the county. The Washington State Patrol has a list of legal and illegal fireworks on their website.

Legal Tribal Land Fireworks

Firecrackers, bottle rockets, missiles, and rockets are legal to possess and discharge on tribal lands ONLY.
These items are illegal in Washington State and become illegal fireworks when possessed off tribal lands.

Fireworks purchased on Indian Reservations such as firecrackers, bottle rockets, missile-type rockets with fins, fireworks with sticks or fins that fly and large re-loadable mortar shells can’t be used off reservations.

Other Illegal Fireworks and Improvised Explosive Devices

M-80’s and larger, dynamite and any improvised, homemade or altered explosive devices such as tennis balls or cherry bombs are illegal explosive devices. Persons in possession or using illegal explosive devices can be charged with a felony.

Sky Lanterns

Sky lanterns are now allowed in Washington State when tethered (i.e. kite string or similar material). The tether must remain attached for the full duration of flight and the lantern material must be recovered and disposed of properly. Any fire started with a sky lantern (tethered or not) is subject to Reckless Burning laws and fire code violations which can amount to both civil fines and criminal charges.
